This Intellectual Property & Anti-Copy Policy (“Policy”) governs the ownership, usage, and protection of all intellectual property associated with Niora (“Company”, “we”, “us”, “our”). By accessing, using, or purchasing any service from Niora, you (“User”, “you”) agree to be legally bound by this Policy.

 

1. OWNERSHIP OF INTELLECTUAL PROPERTY

All rights, title, and interest in and to the following are the exclusive property of Niora, whether registered or unregistered:

  • Website and application UI/UX

  • Software, source code, and system architecture

  • AI pipelines, workflows, automation logic

  • Prompt structures and generation logic

  • Algorithms, datasets, and training workflows

  • Branding, trademarks, logos, and visual identity

  • Marketing materials, product content, and previews

  • Generated outputs, mockups, and media previews displayed on the platform

Nothing on Niora shall be interpreted as granting any license, assignment, or ownership right except as expressly stated in this Policy.

 

2. LIMITED LICENSE TO USERS

Users are granted a limited, non-exclusive, non-transferable, revocable license to use generated outputs solely for:

  • Personal use, or

  • Commercial use for their own brand or business

This license does not grant ownership of:

  • AI models

  • System workflows

  • Prompt engineering

  • Backend logic

  • Infrastructure or automation systems

The Company retains all intellectual property rights at all times.

 

3. STRICTLY PROHIBITED ACTIVITIES

Users are strictly prohibited from, directly or indirectly:

  • Copying, cloning, or reproducing any part of the Niora platform

  • Reverse-engineering or attempting to extract source logic

  • Scraping or bulk-downloading images, mockups, or outputs

  • Training external AI models using Niora outputs

  • Replicating our business model, workflows, or UI design for a competing platform

  • Reselling, sublicensing, or redistributing Niora services or outputs as a standalone service

  • Misrepresenting Niora outputs as outputs of another platform

Any such act shall constitute material breach, copyright infringement, and digital theft.

 

4. SURVEILLANCE & AUTOMATED ABUSE MONITORING

To protect its intellectual property, Niora actively deploys:

  • IP and device fingerprint tracking

  • Behavioral monitoring

  • Automated scraping detection

  • Rate-limit enforcement

  • Abuse-pattern analytics

All suspicious or abnormal activities are logged and may be used as legal evidence.

 

5. ZERO-TOLERANCE ENFORCEMENT

If any User is found violating this Policy:

  • The User’s account shall be immediately and permanently terminated

  • All unused credits shall be forfeited without refund

  • Access to all present and future Niora services shall be permanently revoked

  • Legal proceedings may be initiated without further notice

 

6. LEGAL REMEDIES & DAMAGES

Unauthorized use of Niora’s intellectual property constitutes:

  • Copyright infringement under the Copyright Act, 1957

  • Computer abuse and data theft under the Information Technology Act, 2000

  • Unfair competition under applicable commercial laws

Niora reserves the right to pursue:

  • Injunctive relief

  • Monetary damages

  • Criminal prosecution

  • Platform takedowns

  • Hosting and payment gateway enforcement

  • International IP enforcement where applicable

 

7. THIRD-PARTY PLATFORMS & TAKEDOWNS

If any infringement is detected:

  • DMCA takedown notices may be issued

  • Cloud, CDN, and hosting providers may be notified

  • Payment gateways and marketplaces may be requested to suspend the infringing entity

 

8. NO WAIVER

Failure by Niora to enforce any provision of this Policy shall not constitute a waiver of any rights.

 

9. GOVERNING LAW & JURISDICTION

This Policy shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.
